Santa Cruz Doctor Faces Malpractice Suits, Criminal Charges

Two Incidents in Five Months

A lawsuit was recently filed in Santa Cruz County Superior Court alleging that a brain surgeon at Dominican Hospital failed to provide necessary treatment to a patient. The suit alleges that negligence on the part of the surgeon led to the patient’s preventable death in February of last year. The lawsuit is the second claim filed against the same surgeon for substandard care this year. The first suit involves a patient who says the doctor implanted the wrong size screws during a procedure in October 2016.

The most recent allegations say that the now-deceased patient presented with a severe headache last February. After a radiologist let the surgeon know about “enlarged cavities inside the patient’s brain,” the surgeon failed to take action, the lawsuit claims.

Criminal Distractions?

The lawsuit also poses questions about whether the surgeon may have been distracted from providing quality medical care by his alleged participation in criminal activity. The 57- year-old surgeon was arrested in May 2017 in connection with molesting children. He is currently facing 48 counts of felony charges for the molestation and rape of at least seven children. Prosecutors allege that the list of actual victims may be even longer and may go back as far as 20 years.

The surgeon is currently incarcerated at the Santa Cruz County Jail. His next court appearance in the criminal matter is scheduled for next month. The malpractice proceedings are expected to resume in May.
